We, Lula Smarter Property Maintenance, Inc. (“Company”, “we”, “us”, or “our”) respect your privacy and are committed to protecting it through our compliance with this policy (the “Privacy Policy”). This Privacy Policy describes the types of information you may provide or we may collect from or about you when you use our websites (including www.lula.life), mobile applications, and other online products and services (collectively, the “Services”) and may be amended by Lula from time to time. 

This Privacy Policy applies to information we collect or that is provided to us (a) by you through your use of the Services; or (b) in email, text, and other electronic messages between you and our websites, mobile applications, and other online products.

It does not apply to information collected by us offline or through any other means, including on any other website operated by any third party, including third party websites and mobile applications you may access through the Services, nor does it apply to information collected by any third party including through any application or content (including advertising) that may link to or be accessible from or through the Services, except and to the extent as applicable with respect to the sections of this Privacy Policy reserved exclusively for Customers and Service Providers.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Services. By accessing or using our Services, you agree to this Privacy Policy and our terms of use located at www.lula.life/terms-of-service (“Terms of Use”) and our customer service agreement (if you are a Customer) (“CSA”) and service level agreement (if you are a Service Provider) (“SLA”), as they may be amended by Lula from time to time. This policy may change from time to time. Your continued use of the Services after we make changes is deemed to be acceptance of those changes, so please check this policy periodically for updates. 

Information We Collect About You and How We Collect It.

We collect several types of information from and about users of our Services, including information (a) by which you may be personally identified, such as name, postal address, e-mail address, telephone number, or any other information our websites or mobile applications collect that is defined as personal or personally identifiable information under an applicable law ("Personal Information"); (b) about your internet connection, the equipment you use to access our websites and mobile applications and usage details; and (c) information about you specifically as a Customer or Service Provider, as set forth in more detail below in this Privacy Policy. We collect this information (aa) directly from you when you provide it to us; (bb) automatically as you navigate through the site (information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies); and (cc) from third parties, for example, our business partners and Service Providers.

Information You Provide to Us.  

The information we collect on or through our Services may include (a) information that you provide by filling in forms on our websites and mobile applications, including information provided at the time of registering to use our Services, posting materials, or requesting services; (b) information we ask you for when you report a problem with our Services; (c) records and copies of your correspondence (including email addresses), if you contact us; (d) your responses to surveys that we might ask you to complete for research purposes; (e) details of transactions you carry out through our Services and fulfillment of orders, including financial and payment method information you may be required to provide before placing an order through our Services, as well as information, if you are a Customer, about your properties; and (f) information collected from you when you download, register with, or use our mobile applications, including Personal Information.

You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Services, or transmitted to other users of the Services or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk.   Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies.  

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including (a) details of your visits to our websites, including traffic data, location data, logs, and other communication data and the resources that you access and use on our websites; and (b) information automatically collected about your location when you use our mobile applications; and (c) information about your computer and internet connection, including your IP address, operating system, mobile device, and browser type.

The information we collect automatically is statistical data and does not include Personal Information, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Services and to deliver a better and more personalized service, including by enabling us to (aa) estimate our audience size and usage patterns; (bb) store information about your preferences, allowing us to customize our websites and mobile applications according to your individual interests and geographical location; and (cc) recognize you when you return to our Services.

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser but if you select this setting you may be unable to access certain parts of our Services.   • Flash Cookies. Certain features of our Services may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from and on our Services.   • Web Beacons. Pages of our Services may contain small electronic files known as web beacons (also referred to as clear gifs. pixel tags and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an e-mail and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity). 

We do not collect Personal Information automatically, but we may tie this information to Personal Information about you that we collect from other sources or you provide to us.

Third-party Use of Cookies and Other Tracking Technologies.

Some content or applications, including advertisements, on the Services are served by third-parties, including advertisers, ad networks and servers, content providers and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Services. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. 

We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.  

How We Use Your Information.

We use information that we collect about you or that you provide to us, including any Personal Information, (a) to present our Services and its contents to you; (b) to provide you with information, products, or services that you request from us, as well as to improve our Services and, if you are a Customer, to make those Services more efficient for your properties based on historical use; (c) to fulfill any other purpose for which you provide it; (d) to provide you with notices about your account or subscription, including expiration and renewal notices; (e) to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection; (f) to notify you about changes to our Services; (g) to share your information with our Service Providers and third party application providers (including as set forth below regarding disclosures for which you have not opted out of); (h) to allow you to participate in interactive features on our websites and mobile applications; (i) to improve our, our service partners, and our customers technology and applications, including for statistical compilations, databases, reports, research, and product improvement and to one or more third party providers, affiliates, or business relationships in an effort to improve products, services, and systems; (j) in any other way we may describe when you provide the information; (k) as may be set out in the SLA, CSA, and Terms and Conditions; and (l) for any other purpose with your consent or as may be consistent with applicable law.

Disclosure of Your Information.

We may disclose aggregated information about our users, and information that does not identify any individual (including de-identified information), without restriction. We may also disclose Personal Information that we collect from you or you provide as described in this Privacy Policy (a) to our affiliates; (b) to contractors, Service Providers, and other third parties we use to support our business, including our payment processing and billing application providers (including Stripe) and/or that may be useful to improve products, services, and systems (including the Services); (c) to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by the us about our Services users is among the assets transferred; (d) to third parties to market their products or services to you if you have not opted out of these disclosures; (e) to fulfill the purpose for which you provide it (for example, if you give us an email address to use an “email a friend” feature of our websites or mobile applications, we will transmit the contents of that email and your email address to the recipients); (f) for any other purpose disclosed by us when you provide the information; and (g) with your consent. 

We may also disclose your Personal Information (aa) to comply with any court order, law, or legal process, including to respond to any government or regulatory request; (bb) to enforce or apply our Terms of Use, SLAs, CSAs, and other agreements, including for billing and collection purposes; and (cc) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Lula, our customers, or others (this includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction).

Choices About How We Use and Disclose Your Information.

You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe's website. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

If you do not wish to have your email address used by the Company to promote our own or third parties' products or services, you can opt-out by sending us an email stating your request using the contact information on the last page of this Privacy Policy. This opt out does not apply to information provided to or by the Company as a result of a product purchase, warranty registration, product service experience or other transactions.

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

Accessing and Correcting Your Personal Information.

You can review and change your Personal Information by logging into the website or mobile applications and visiting your account profile page. 

Children Under the Age of 13.

The Services are not intended for children under 13 years of age and we do not knowingly collect Personal Information from children under 13. Further, if you are under 18 years of age, do not use or provide any information on or through our Services, make any purchases on or through the Services, use any of the interactive or public comment features of the Services or provide any information about yourself to us, including your name, address, telephone number, photos, videos, email address, any screen name or user name you may use, or any other Personal Information. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us using the contact information on the last page of this Privacy Policy. 

Your California Privacy Rights.

California Civil Code Section § 1798.83 permits users of our Services that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an email using the contact information on the last page of this Privacy Policy.

Data Security.

We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration and disclosure. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential and we urge you to be careful about giving out information in public areas of the Services like message boards and feedback posts. Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to or through the Services. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide. 

Provisions Specifically for Customers

If you use our Services to request services (a “Customer”) from one or more of our service providers that provide requested job services through our Services (each, a “Service Provider”), the following shall apply: 

We may collect information about (a) your and your properties’ physical location, such as information obtained through geolocation information services and third party map apps with respect to your property or business address; (b) your schedule or calendar information we collect from your mobile device; and (c) the condition of one or more properties owned by you, including information we receive from our Service Providers; and (d) information that you voluntarily post to or through the Services such as ratings, comments, and other feedback with respect to Service Providers (which shall constitute “User Contributions” for the purposes of this Privacy Policy). We may also collect information about you that you authorize us to collect through our CSA.  Please note, by using or accessing the Services, your properties’ address will be shared with our Service Providers. 

Should you wish to remove information that you voluntarily post to or through the Services, you may contact us at the email address set forth at the end of this Privacy Policy; however, we retain the sole discretion to remove, retain, or alter any feedback, comments, or ratings that you submit to or through the Services with respect to any Service Provider. We reserve the right to hold any of your account information or data required to be maintained by law or in order to resolve any potential disputes arising from your use of the Services, including if you have a standing credit or debt on your account or if we believe you have committed fraud or violated the terms of the CSA or the Terms of Use.   

We may seek permission for our mobile applications’ collection of precise location from your device per the permission system used by your mobile operating system.  If you initially permit the collection of this information, you can later disable it by changing the location settings on your mobile device. However, this will limit your ability to use certain features of our Services and may affect your ability to receive job services.  Additionally, disabling our mobile applications’ collection of precise location from your device will not limit our ability to collect your properties’ physical location information from the address you provide to us or from a Service Provider’s device nor our ability to derive approximate location from your IP address. You hereby expressly consent to our use of location-based services and expressly waive and release us from any and all liability, claims, causes of action or damages arising from your use of the Services, or in any way relating to the precise location and other location-based services.

This information about you may be shared with our Service Providers as part of the service delivery process. 

Provisions Specifically for Service Providers 

If you are a Service Provider, the following shall apply:

We may collect information about (a) you and your company; (b) your personal background or the background of one or more of your agents; (c) your professional qualifications and the professional qualifications of one or more of your agents; and (d) your location and tracking information, including information pertaining to whether you or your agents are en route to one or more job locations that we obtain through third party geolocation informational services or apps or your or your agents’ mobile device. We may also collect information about you that you authorize us to collect through the SLA. 

You hereby expressly consent to our use of location-based services and expressly waive and release us from any and all liability, claims, causes of action or damages arising from your use of the Services, or in any way relating to the precise location and other location-based services.

We reserve the right to hold any of your account information or data required to be maintained by law or in order to resolve any potential disputes arising from your use of the Services, including if you have a standing credit or debt on your account or if we believe you have committed fraud or violated the terms of your SLA or the Terms of Use.  

This information about you may also be shared with our Customers as part of the service delivery process.  

Changes to Our Privacy Policy.

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users' Personal Information, we will post the new privacy policy on this page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for periodically visiting this privacy policy to check for any changes.
